Clerk of Court II

SUMMARY:
The Clerk of Court II provides advanced level clerical, case processing and courtroom duties of a specialized and complex nature, with limited supervision. The Clerk II manages assigned court cases to receive, examine, prepare and process a variety of legal documents in support of the court operations and dockets accordingly. This includes providing training to subordinate staff on specific case types.

QUALIFICATIONS:
• Bachelor’s degree with three years of progressively responsible administrative work experience required – or – Associates degree with five or more years of Court Clerk or legal administrative work experience required.
• Must become certified and pass the advanced certification within one year of hire, required; possession of standard certification as a court clerk is a plus.
• Excellent human relation skills and ability to work effectively with public and staff required.
• Excellent verbal and written communication skills including an ability to articulate orally and write effectively, required.
• Strong computer knowledge and experience in the following: word processing, spreadsheet and ability to operate and troubleshoot court management system data base software, required.
• Considerable knowledge of court procedures and policies, laws, legal terminology and legal factors pertaining to the court, required; and a familiarity when Band, Federal or State statutes apply.
• Familiarity with Indian legal system and court systems is required.
• High degree of personal integrity and ethics, required.
• Ability to organize work effectively and priorities under timeline pressures; and able to handle multiple tasks with attention to detail and adapt to frequently changing work demands.
• Thorough working knowledge of the Band’s statutes of maintaining confidentiality in all court and office matters.
• Demonstrate the understanding between legal advice and legal information.
• Type 50 words per minute, required and will be tested.
• Valid and current Minnesota Driver’s License and the ability to be insured by the Band’s insurance policy required.
• Unblemished background.

DUTIES AND RESPONSIBILITIES
• Provides wide-range of work direction to court staff regarding workflow, processes and procedures of assigned court cases.
• Advanced case processing and courtroom duties, which may be of a routine, specialized or complex nature.
• Participate in clerks meeting with the Court Administrator and/or District Court Judge.
• Assist with Trouble shooting systems under the direction of the Chief Court Clerk or Court Administrator. Systems include FullCourt Enterprise Case management, Liberty Recording, File & ServeXpress and Extron systems.
• Ensure that all court documents are filed within respective case jacket.
• Receive, and examine legal documents submitted to court for adherence to laws or court procedures; stamp all court filings of all legal pleadings.
• Data entry of orders and judgments, ensure case status is up-to-date and hearings are resulted in the court management system.
• Responsible for recording of court hearings; mark, stores and files exhibits; maintain court docket and master calendar for the court and court events.
• Notifies all parties of record regarding hearings, continuances, cancellations, rescheduling and other activities of the court.
• Proofread and edits court orders for correct dates, names, addresses, etc.
• Routinely drafts simple, standard proposed court orders.
• Assist the other Court Clerks and/or serve as the back up in the absence of a Clerk.
• Assists litigants with proper forms, copies of relevant Tribal Law & Codes without giving legal advice.
• Prepare courtroom for hearings and ensure that the recording equipment is working.
• Audit cases for closure; ensuring files are complete with case summaries and related documents.
• Processes appeal cases when necessary.
• Travel to the District II and III for court hearings twice a month or when necessary.
• Records court fees and fines; issuing receipts to payees related to assigned case type.
• Answers inquiries and communicates with the public, litigants, attorneys, and internal & external agencies.
• Other duties as assigned.

WORKING CONDITIONS:
• Nature of work is such that incumbent experiences sustained periods of high levels of stress from workload, nature of work, or nature of interactions with others, both inside and outside of the Band.
• Work is almost exclusively in doors in a controlled climate area.
• Moderate threat of personal danger or risk.
• Hours are typically 8-5, but extra hours may be necessary to meet deadlines and maintain workload. May involve some evening or weekend working.
• Local travel is required to travel to District II & III twice per month depending on scheduled hearings; limited travel outside the state is also required.
